1. Acceptance of these terms

By accessing or using Quick5k.com (the "Site") or any of the services Quick5k LLC ("Quick5k", "we", "us", or "our") makes available through the Site, you agree to be bound by these terms of service (the "Terms") and by our privacy policy and legal disclaimer. If you do not agree to these Terms, do not use the Site.

2. Eligibility

To use the Site or submit a request through it, you represent and warrant that you are at least 18 years of age, a legal resident of the United States, and able to enter into a binding contract. Quick5k is intended for use by US residents only. You agree to use the Site in accordance with the lending laws of your state of residence.

3. Description of the service

Quick5k is a marketing service that connects consumers with a network of third-party lending partners offering small-dollar, short-term personal loans, typically in amounts from $500 to $5,000. We are not a lender, broker, or financial advisor. We do not make credit decisions, set rates, originate loans, service loans, or collect payments. Any loan agreement you enter into is solely between you and the lender you choose.

4. Use of the site

You agree to use the Site only for lawful purposes and only as described in these Terms. You agree not to:

• Submit false, misleading, or incomplete information.
• Use the Site on behalf of another person without authorization.
• Attempt to interfere with the Site, scrape it, or otherwise access it in an unauthorized manner.
• Use the Site to violate any law, regulation, or third party right.

5. Your submissions

When you submit information through the Site (for example, your name, email, phone, state, income, or other loan-related information), you grant Quick5k a worldwide, non-exclusive, royalty-free right to use, store, share, and process that information to provide and improve the service, to match you with lenders in our network, and as otherwise described in our privacy policy. You confirm the information you submit is true, accurate, and your own.

6. Third-party lenders

If a lender in our network is interested in your request, it will reach out to you directly. Any loan you receive is governed by the lender's own loan agreement and the laws of your state. Quick5k is not a party to that agreement and makes no guarantee that you will be approved, that any specific loan amount, rate, term, fee, or repayment schedule will be available, or that any lender will contact you. Lenders may perform their own credit checks, including hard inquiries, and may decline applications for any lawful reason.

7. No warranty

The Site and the service are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Quick5k disclaims all warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, title, and non-infringement. We do not warrant that the Site will be uninterrupted, error free, or free of viruses or other harmful components, and we do not warrant any results from using the service. Information on the Site, including Money Hacks articles and calculator outputs, is for general information only and is not legal, tax, accounting, or financial advice.

8. Limitation of liability

To the maximum extent permitted by law, in no event will Quick5k, its affiliates, officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with the Site or the service, even if we have been advised of the possibility of such damages. Our total cumulative liability to you arising out of the Site or these Terms will not exceed one hundred US dollars ($100).

9. Indemnification

You agree to indemnify, defend, and hold harmless Quick5k and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of the Site or the service, (b) your violation of these Terms, or (c) your violation of any law or third party right.

10. TCPA consent: calls, texts, and automated technology

By submitting your information through the Site, including a phone number, you expressly consent and agree to receive marketing, transactional, and informational calls and text messages from Quick5k and its lending partners and service providers at the phone number you provided, including via automatic telephone dialing systems, artificial or prerecorded voice, and automated text messaging technology, even if your number is on a federal or state do-not-call list.

You understand and agree that this consent is not a condition of receiving any goods or services from Quick5k or any lender. Message and data rates may apply. Message frequency varies. You may opt out of marketing text messages at any time by replying STOP to any message you receive, or by contacting us using the information in the "Contact" section below. Opting out may take up to ten business days to take effect.

11. Privacy

Our collection, use, and disclosure of your information is described in our privacy policy, which is incorporated into these Terms by reference. By using the Site, you agree to the terms of the privacy policy.

12. Modifications

We may change these Terms from time to time. If we make material changes, where appropriate, we will provide additional notice. Your continued use of the Site after the changes take effect means you accept the updated Terms.

13. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Any dispute arising out of or in connection with these Terms or the Site will be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts. Nothing in this section limits any non-waivable consumer rights you may have under the laws of your state of residence.
